1. What these Terms cover
These Terms cover the Site only. Paid services, including AI Opportunity Audits, workflow automation builds, AI Employee builds, and Run and Govern retainers, are governed by a separate signed agreement and statement of work (SOW). If those documents conflict with these Terms, the signed agreement controls. Descriptions and prices on the Site are for general information and are not an offer. Scope, pricing, and deliverables are set only in a signed agreement.
2. Using the Site
You may use the Site for lawful purposes. You agree not to:
- Break any law or violate anyone's rights
- Try to gain unauthorized access to the Site, its servers, or connected systems
- Interfere with the Site's operation, including by uploading malware or overloading it
- Scrape, crawl, or harvest data from the Site by automated means, except standard search engine indexing
- Submit false information or impersonate any person or company
- Send spam or unsolicited messages through our forms
- Use Site content to build a competing product or train AI models without our written permission
We may suspend or block access to anyone who violates these Terms.
3. Information you submit
When you submit a form or contact us, you confirm the information is accurate and that you have the right to share it. Please don't send confidential or sensitive information through the Site. 7. Limitation of liability
To the fullest extent the law allows, Mercury Digital and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site. Our total liability for any claim related to the Site is limited to one hundred U.S. dollars (US $100). Some jurisdictions don't allow certain limits, so some of these may not apply to you.
8. Indemnity
You agree to defend and indemnify Mercury Digital against claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

11. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us about the Site (but not about paid services, which are covered by a signed agreement).
